In just about every state where gay marriage is legalized, the debate and legislation started via a referendum. See Washington, California (the reasons Prop 8 failed are due almost entirely to the LDS flinging $50 million into an advertising campaign), etc.
Prop 8 didn't fail it is now in the courts.

I agree with you here, actually. Though I'd say that the Obama administration trying to enforce this wasn't actually a policy move but a political one. They've changed the entire dynamic of the GOP caucuses, more or less forcing the candidates to adopt a hard-line conservative (read: draconian/13th century/puritanic, etc) stance on social issues (see Santorum's remarks last week about how pleasure fucking is immoral, and contraception is simply a means to perform sinful acts), which is isolating most moderate voters (like me).
